Can you video the police when they are encountering someone or making an arrest

A police officer can video you when they encounter you, did you know you have the right to do the same? People have been arrested and had their videos destroyed for doing so but many courts are dismissing the arrest and the police are being sued in many cases for violating the 1st, 4th and 14th amendments. Know your rights.  As long as you are not resisting, obstructing, or otherwise interfering with a police officer or an investigation, you have the right to video a police officer in public performing of his/her duties.  In today's world of smartphones that can record everything, it is not unusual for police interactions to be video taped by people watching the events unfold.  Many times the people are ordered to quit videoing or they will be arrested.  As long as you are not interfering with the police officer being able to cary out his duties in public, you have the right to continue.  You might be arrested or your video confiscated but there is a good chance the charges will be thrown out and you may be able to sue the officer and his/her department for violating your constitutional rights.  Be careful, be smart, and be safe, but also be informed as knowledge is power.
